Terms and Conditions pages aren’t just so you can make your affiliates happy. They are a very important part of your websites legal health!
What are terms and conditions?
Terms and conditions are like a contract between you and your reader. They outline what your reader should expect of your website, and they outline what your reader should or should not do while visiting your website.
When a person goes to your website, they should be able to easily access your terms and conditions. Many people chose to use a pop up so that people actually have to agree to them. That is how important terms and conditions are!
What should you have in your terms and conditions?
Below are some of the important clauses that everyone needs to have in their terms and conditions!
An over 18 Clause
If your website does not target children, then you want to make sure that you have this clause. The Children’s Online Protection Act was enacted to help protect children from the craziness that is the internet. By adding this clause, you are making sure that the person is not a child! Also, children cannot enter into contracts like adults, so there could be a risk that your terms and conditions wouldn’t apply if you didn’t have this clause.
Waiver of Liability
People do dumb things on the internet, and you DO NOT want that to ruin your business and website. You want to waive all liability if someone where to use and or abuse the information found within your website. This clause should include a risk provision that says that the person agrees to the risk of using the information found of the website.
Your terms and conditions should have something about what you are allowing people to do with your Intellectual Property that is found on your site. For instance, if you don’t want people to use it at all, then you should say that. A statement such as all the Intellectual Property of this website belongs to the Website. Any unauthorized use, is an infringement upon these rights. Readers/viewers are not to reproduce, copy, use or anything similar.
A lot of Bloggers and websites have comment section. You want a clause that lets your readers know that certain behaviors such as stalking or harassing, will not be tolerated and that the comment will be taken down and the person removed. Also, this clause should have a provision that waives liability/ indemnifies if a person does the “bad behavior.”
These are just a few of the clauses. You can add as many or as few as you think necessary.
